Divine Spark Fireworks – Terms & Conditions/policies

Welcome to Divine Spark Fireworks!
By purchasing fireworks from us, you agree to the Terms & Conditions below. Please read them carefully before making a purchase.
1. All Sales are final / Refund and return
- All purchases are final – no refunds, returns, or cash exchanges.
- If management authorizes an exchange, the full value must be applied toward other fireworks only.
- No credit, cash, or alternative merchandise will be provided.
2. Pickup & Legal Sale Times
- Fireworks must be picked up in person at an approved Divine Spark Fireworks location.
- Pickup is allowed on during dates and times permitted by State, County, and City rugulations.
- Customers are responsible for following all local and state laws regarding the purchase, possession, and use of fireworks.
3. No Shipping
- Due to federal and state regulations, we do not ship fireworks.
- All orders must be picked up in person at an authorized location.
4. Age Requirement
- Buyers must be at least 16 years of age or be accompanied by someone who is at least 16.
- By purchasing, you confirm that you meet this age requirement and are legally allowed to buy fireworks in your area.
5 Condition of Fireworks
- All fireworks are sold “AS IS.”
- Divine Spark Fireworks is not the manufacturer and provides no warranties, express or implied, regarding performance, safety, or reliability.
- All products are believed to be in working condition at the time of sale.
6 Assumption of Risk
- By purchasing or using our fireworks, you accept all risks associated with handling, lighting, and discharging them.
- Divine Spark Fireworks and its employees are not responsible or liable for any injury, death, property damage, or losses resulting from the use or misuse of fireworks.
7. Legal Compliance
- You are responsible for following all local, county, and state laws regarding fireworks use and possession.
- Divine Spark Fireworks is not responsible for any legal violations by the purchaser or user.
8. Indemnification
- By purchasing from us, you agree to indemnify and hold harmless Divine Spark Fireworks and its representatives from any claims, damages, or expenses (including attorney fees) related to your purchase, possession, or use of fireworks.
9. Changes to these terms
- Divine Spark Fireworks may update or modify these Terms and Conditions at any time without prior notice.
- Any changes will take effect immediately upon being posted at our locations or on our website.

- By purchasing or using fireworks from Divine Spark Fireworks, you understand that voluntarily accept all risks associated with their handling, storage, transportation, and ignition.

- Divine Spark Fireworks is not the manufacturer of any fireworks products.
- All fireworks are sold as-is and believed to be in working condition at the time of sale.
- We do not make, and herevy disclaim, any warranties performance, safety, or reliability.
3. Use at your own risk
- You agree that Divine Spark Fireworks, its owners, employees, and affiliates are not responsivle for any accidents, injuries, deaths, or property damage resulting from the use or misuse of any fireworks purchased.
- Fireworks should only be used outdoors, in safe, legal areas, and in compliance with all state, county, and city laws.
4. Safe Handling Guidelines
- Please observe the following safety practices:
- Only ignite fireworks outdoors, on a flat, stable, and fire-resistant surface.
- Keep a bucket of water or fire extinguisher nearby at all times.
- Never aim, throw, or hold lit fireworks in your hand.
- Never attempt to relight or handle “duds” — wait 20 minutes and then soak them in water.
- Keep fireworks away from spectators, animals, buildings, and vehicles.
- Only sober, responsible adults or supervised youth (16+) should handle fireworks.
- Dispose of used fireworks properly after soaking them in water.
5. Local Law Compliance
- Fireworks laws vary by location. The purchaser is responsible for ensuring that the purchase, possession, and use of fireworks comply with state, county, and local laws.
- Divine Spark Fireworks reserves the right to refuse sales if we believe local or state laws prohibit your purchase.
6. Limitation of Liability
- To the fullest extent permitted by law, Divine Spark Fireworks and its affiliates shall not be liable for any damages, injuries, or losses of any kind arising out of the purchase, possession, transportation, or use of fireworks.
- By purchasing from Divine Spark Fireworks, you expressly release, discharge, and hold harmless Divine Spark Fireworks, its owners, and employees from any and all liability or claims.
